COVID-19 Amendments: Please read and understand – updated 10/20/2022


  1. Do not come to class if you are feeling ill or anyone in your house is feeling ill, this is not negotiable.
  2. If you are displaying symptoms and asked to leave please, get yourself better and rejoin us at a later date.

Please read these Terms and Conditions (“Terms”). These Terms govern your membership and use of the Clamtown’s facilities and services. By enrolling in a membership or using the facilities, you agree to abide by these Terms.

1. Membership Agreement

1.1. Membership Types: Clamtown offers various membership plans, including but not limited to monthly, quarterly, and annual memberships. Memberships are non-transferable.

1.2. No Refunds: By enrolling in any membership, you acknowledge and agree that Clamtown does not provide refunds for any reason.

2. Membership Fees

2.1. Payment: Membership fees are payable in advance, and you agree to pay the agreed-upon fees on time. Failure to pay fees may result in suspension or termination of your membership.

2.2. Fee Changes: Clamtown reserves the right to change membership fees at any time. Any changes will be communicated to members through reasonable means, such as email or notice posted in the Gym.

3. Cancellation and Termination

3.1. Membership Duration: Memberships are active for the duration specified in your membership agreement, and they automatically renew unless canceled as per the terms of the agreement.

3.2. Cancellation: To cancel your membership, you must notify staff 60 days in advance, which may vary depending on your membership type. Cancellation requests should be made using the form on the FAQ page.

3.3. Termination: Clamtown reserves the right to terminate your membership for any violation of these Terms, inappropriate behavior, or other reasons at the discretion of staff.

4. Use of Facilities

4.1. Gym Rules: Members must adhere to the Clamtown’s rules and guidelines posted on the premises, including safety and hygiene protocols.

4.2. Liability: Clamtown is not responsible for any injuries or accidents that occur on its premises. You use the Clamtown’s facilities at your own risk.

5. Privacy

5.1. Information Collection: Clamtown may collect and use personal information as described in its Privacy Policy, which is available upon request.

5.2. Communication: By providing your contact information, you consent to receive communications from the Clamtown, including promotional materials and updates.

6. Miscellaneous

6.1. Amendments: Clamtown reserves the right to amend these Terms at any time, and such changes will be effective immediately upon posting on the Clamtown’s website or notification to members.

6.2. Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

6.3. Governing Law: These Terms shall be governed by and construed in accordance with the laws of Ocean County, New Jersey.

By joining Clamtown Fitness in Tuckerton, you acknowledge that you have read, understood, and agree to these Terms and Conditions. If you do not agree with any part of these Terms, please do not become a member of the Clamtown.

HOLD POLICY

As stated in your membership agreement, you have the option to put your automatically recurring membership on hold for injury or illness.
1. You can put your membership on hold for financial hardship, such as loss of a job. This, however, does not count towards your 60 day cancellation notice. Your membership will automatically continue you after the hold duration.
2. If you are putting your membership on hold for an injury or illness, a doctor’s note is required.
3. You cannot put your membership on hold for vacations.
4. Upon expiration of the hold period that you select below, your account will automatically reactivate and regular membership payments will resume. If you choose to cancel your membership during the hold period, the standard 60 day notice requirement stated in your membership agreement is applicable. If you choose to reactivate your membership after it is canceled, membership rates in effect at the time of reactivation will be applicable (membership rates are subject to change).
*Membership Hold can take up to 7 days to process.

CANCELLATION POLICY

If you are 100% sure that you would like to cancel your membership, please follow the steps below:
1. If you decide to reactivate your membership in the future (and we hope you do) membership rates in effect at the time of reactivation will be applicable as membership rates are subject to change.
2. We DO NOT accept cancellation requests through text, email, or voice.
3. If you’re sure you’d like to cancel, just complete and submit the form below 60 days prior to your cancellation date.
4. Once the form is filled out, please check your email.
